i recently got a dui charge for supposedly swaying in the road. my lawyer said i should have been allover the road before the stop was even justified. i had a prescription med in my purse and was charged for simple possession. then the guy decided he would try to charge me with a dui also. he made me get out of the car and nearly shut the door on me. he was very irate and yelling and screaming in my face. i was only doing whatever he asked, so i don't know whyhe was so upset. i have heard since that he is that way all the time. he had four other officers at least tear my car inside out and gave me field tests. he said i failed ( of course) and took me in. he did not offer a test and i did not refuse one. the judge in court today wanted to know how this case got this far with no test, report, or evidence such as a tape. the grand jury decided to hear it, and the judge wanted to know what was presented to them for them to make this decision. i feel i have a good chance of beating this because of the way it was handled, but i am still worried about it. has anyone ever heard of such a case before?

Here's the deal.. obviously no one should drink and drive, but sometimes the police are over-reacting.. (like the example of the guy who's son was moving the car on the beach).. that's crazy.... but that's exactly the type of case where a good dui lawyer may be able to aggressively defend you.. not tricks.. not loopholes..but aggressive defense.

I've read this book "Dui-Myth" and it's terrific. Anyone who goes to court without at least reading this book is crazy.. information is king.

Well i got a DWI in Missouri this was my first offense too... when i was going their to visit some friends. I live in Illinois though. any way i went to court and got an SIS (that like covers up that you had a DWI) somewhere n illinois or missouri they screwed up my paper work and said i was convicted and now i have my Illnois Liciense REVOKED for 2 years till Nov. 2009 and Missouri is givin me my license back their n 90 days.....now thats pretty messed up!! Huh?

iam pretty upset as my son has currently lost his chance of becoming a UPS driver now for 3 years because of a license suspension for a dwi that was ridiculous.He was at the beach, put up a tent on the beach so that they would not be driving. They walked across the street to a bar. When they passed my sons car parked on the street, 2 officers asked if that was his car and if so, they asked my son to move it as it was not legally parked. He told them he did not feel comfortable moving it at that time as he had been drinking so the officer said that he would move it for him and pulled the car into a public beach access parking lot but parked it sideways taking up 2 spaces. 5 hours later or so, my son and friend were walking back across the street to their tent on the beach and my son decided he was afraid his car would be towed overnight since it was parked like that and began to move it 20 ft in to a single space and the same police officers had apparently been waiting there and immediately arrested him before he could even get back out of his car and charged him with a dwi because of course he did blow over as he never intended to drive anywhere. amazing, huh?
